At BAHA Enterprises, LLC (“BAHA”, “we” or “us” or “our”), we respect the privacy of our Users (“User,” “your” or “you”). This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you visit our website i.e., www.bahaenterprises.com, including any other media form, media channel, mobile website, or mobile application related or connected thereto (collectively, the “Site”) and all associated Services i.e., including but not limited to advisory and validation services (collectively, the “Services”).

This Privacy Policy does not apply to any other website or digital service that you may be able to access through this Site. Each of those third-party websites may have their own privacy policy and that may differ from our Privacy Policy. Your use of the Site and the Services is governed by this Privacy Policy and the Terms of Use. Any capitalized term used but not defined in this Privacy Policy shall have the meaning in the Terms of Use.

This Privacy Policy describes how BAHA collects and uses the Personal Information you provide on, and other information that is collected from your use of the Site. It also describes the choices available to you regarding our use of your Personal Information and how you can access and update this information.

1. WHAT INFORMATION WE COLLECT

a. Personal Information

When you access the Site and the Services, we may ask you to voluntarily provide us certain information that personally identifies you or could be used to personally identify you (“Personal Information”). Personal Information includes (but is not limited to) the following categories of information: (1) contact data (such as your e-mail address and phone number); (2) demographic data (such as your gender, your date of birth and your zip code); (3) medical data (such as any history of medical problems, any specific health concerns and limitations); and (4) other identifying information that you voluntarily choose to provide to us, including without limitation unique identifiers such as passwords, and Personal Information in emails or letters that you send to us. Please note that you are under no obligation to provide us with Personal Information of any kind, however your refusal to do so may prevent you from using certain features of the Site and our Services.

b. Billing Information

When you make payments through our Site, you may need to provide your shipping address and financial account information, such as your credits card number, to our payment processing partner. We do not collect or store financial account information, though we may receive transaction identifiers and summary information that does not include credit cards or bank accounts.

c. Derivative Data

We may also collect certain data automatically when you access the Site or use our Services, such as your IP address, your browser type, your operating system, your access times, and the pages you have viewed directly before and after accessing the Site.

d. Data from Contests, Giveaways, and Surveys

We may also collect your Personal information along with other additional information that you may have provided when entering contests or giveaways and/or when responding to surveys.

e. HIPAA and PHI

Under a federal law called the Health Insurance Portability and Accountability Act (“HIPAA”), some demographic, health and/or health-related information that BAHA collects as part of providing access to the Site and the Services, may be considered as protected health information (“PHI”). Specifically, when BAHA receives identifiable information from you including but not limited to information about any current diseases or health conditions that you may have, this information is considered PHI.

2. HOW WE COLLECT INFORMATION

We collect information (including Personal Information and derivative data) when you use and interact with the Site and the Services. Such means of collection include: (1) when you register with the Site; (2) when you subscribe to our newsletter; (3) when you voluntarily provide information through responses to surveys, questionnaires and the like; (4) when you use contact us directly using the “Contact Us” function on our website; (5) when you voluntarily agree to allow us to publish your information on our Site; and (6) through cookies and other tracking technology available on our Site.

We may share your information with our affiliates, in which case we will require those affiliates to honor this Privacy Policy. Affiliates include our parent company and any subsidiaries, joint venture partners or other companies that we control or that are under common control with us.

d. Business Partners

We may share your information with our business partners to offer you certain products, services or promotions.

We may share your information with advertisers and investors for the purpose of conducting general business analysis. We may also share your information with such third parties for marketing purposes, as permitted by law.

f. Sale or Bankruptcy

If we reorganize or sell all or a portion of our assets, undergo a merger, or are acquired by another entity, we may transfer your information to the successor entity. If we go out of business or enter bankruptcy, your information would be an asset transferred or acquired by a third party. You acknowledge that such transfers may occur and that the transferee may decline honor commitments we made in this Privacy Policy.

g. Your Sharing of Information

We are not responsible for the actions of third parties with whom you share personal or sensitive data, and we have no authority to manage or control third-party solicitations. If you no longer wish to receive correspondence, emails or other communications from third parties, you are responsible for contacting the third party directly.

h. Aggregated Information

We may disclose information that is neither Personal Information nor PHI (including non-PHI Personal Information that has been de-identified and/or aggregated) at our discretion. Such aggregated information shall not identify a single user.

5. TRACKING TECHNOLOGIES

We may use cookies, web beacons, tracking pixels, and other tracking technologies on the Site to help customize the Site and our Services and improve your experience.

a. Cookies

“Cookies” are small computer files transferred to your computing device that contain information such as user ID, user preferences, lists of pages visited and activities conducted while using the Site and the Services. We use Cookies to improve or tailor the Services or customize advertisements by tracking navigation habits, measuring performance, storing authentication status so re-entering credentials is not required, customizing user experiences with the Site and the Services and for analytics and fraud prevention.

b. Web Beacons

“Web Beacons” are tiny graphic image files embedded in a web page or email that may be used to collect information about the use of our Site and the Services, the websites of selected advertisers and the emails, special promotions or newsletters that we send. The information collected by Web Beacons allows us to analyze how many people are using the Site, using selected publishers’ websites or opening emails, and for what purpose, and also allows us to enhance our interest-based advertising (discussed further below).

c. Website Analytics

We may also partner with selected third-party vendors, such as Google Analytics, to allow tracking technologies and remarketing services on the Site through the use of first party cookies and third-party cookies, to, among other things, analyze and track users’ use of the Site, determine the popularity of certain content and better understand online activity. By accessing the Site, you consent to the collection and use of your information by these third-party vendors. You are encouraged to review their privacy policy and contact them directly for responses to your questions. We do not transfer Personal Information to these third-party vendors. However, If you do not want any information to be collected and used by tracking technologies, you can visit the third-party vendor or Network Advertising Initiative Opt Out Tool or Digital Advertising Alliance Opt Out Tool. You should be aware that getting a new computer, installing a new browser, upgrading an existing browser, or erasing or otherwise altering your browser’s cookies files may also clear certain opt-out cookies, plugins, or settings.

6. THIRD-PARTY WEBSITES

The Site may contain links to third-party websites and applications of interest, including advertisements and external services, that are not affiliated with us. Once you have used these links to leave the Site, any information you provide to these third parties is not covered by this Privacy Policy, and we cannot guarantee the safety and privacy of your information. Before visiting and providing any information to any third-party websites, you should inform yourself of the privacy policies and practices (if any) of the third party responsible for that website, and should take those steps necessary to, in your discretion, protect the privacy of your information. We are not responsible for the content or privacy and security practices and policies of any third parties, including other sites, services or applications that may be linked to or from the Site.

7. SECURITY OF YOUR INFORMATION

We follow generally accepted industry standard administrative, technical, and physical security measures to help protect your Personal Information submitted to us, both during transmission and in storage. For example, when you enter sensitive information on our Site, we encrypt that information using Secure Socket Layer (SSL) technology.

While we have taken reasonable steps to secure the Personal Information you provide to us, please be aware that despite our efforts, no security measures are perfect or impenetrable, and no method of data transmission can be guaranteed against any interception or other type of misuse. Any information disclosed online is vulnerable to interception and misuse by unauthorized parties. Therefore, we cannot guarantee complete security if you provide Personal Information.

If at any time during or after our relationship we believe that the security of your Personal Information may have been compromised, we may seek to notify you of that development. If we have your e-mail address, we may notify you by e-mail to the most recent e-mail address you have provided us in your account profile. Please keep your e-mail address in your account up to date. You can update that e-mail address by sending us an email informing us about the change at info@bahaenterprises.com.

8. POLICY FOR CHILDREN

Our Site and/or our Services are not intended for persons under 18 years of age. No one under age 18 may provide any information to our Site and/or our Services. Specifically, we do not knowingly collect Personal Information from children under 13. If you are under 13, do not use or provide any information on our Site or our Services. Additionally, if you are under 13, please do not provide any information about yourself to us, including your name, address, telephone number, e-mail address or any screen name or user name you may use. If we learn we have collected or received Personal Information from a child under 13 without verification of parental consent, we will delete that information. 9. CONTROLS FOR DO-NOT-TRACK FEATURES

Most web browsers and some mobile operating systems include a Do-Not-Track (“DNT”) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. No uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this Privacy Policy.

10. USERS OUTSIDE THE UNITED STATES

Please note that Site and our Services are only available for use in the United States (“US”). Do not access and use our Site and Services if you reside outside the US. Please be aware that information you provide to BAHA may be processed and transferred to the US and be subject to applicable US. The privacy and data protection laws in the US may not be equivalent to such laws in your country of residence.

Our Site and/or Services are not available for use and download in the European Union, European Economic Area and in Switzerland. Currently, we are not providing Services in the European Union, European Economic Area and in Switzerland. Please do not register for our Services if you live in anywhere in the European Union, European Economic Area or in Switzerland. If we discover any unauthorized registration on our Site, we reserve the right to terminate the registration.

By using the Site and/or the Services, or by providing BAHA with your information (as detailed under this Privacy Policy), you consent to this collection, transfer, storage, and processing of information to and in the US. BAHA will take all steps reasonably necessary to ensure that your data is treated securely in accordance with this Privacy Policy. 11. OPTIONS REGARDING YOUR INFORMATION

a. Account Information

You may at any time review or change the information in your account or terminate your account by contacting us using the contact information provided below. Upon your request to terminate your account, we will deactivate or delete your account and information from our active databases. However, some information may be retained in our files to prevent fraud, troubleshoot problems, assist with any investigations, enforce our Terms of Use and/or comply with legal requirements.

b. Emails and Communications

If you no longer wish to receive correspondence, emails, or other communications from us, you may opt-out by contacting us using the contact information provided. If you no longer wish to receive correspondence, emails, or other communications from third parties, you are responsible for contacting the third party directly.

12. CALIFORNIA PRIVACY RIGHTS

California Civil Code Section 1798.83, also known as the “Shine The Light” law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of Personal Information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared Personal Information in the immediately preceding calendar year. If you are a California resident and would like to make such a request, please submit your request in writing to us using the contact information provided below.

If you are under 18 years of age, reside in California, and have a registered account with the Site, you have the right to request removal of unwanted data that you publicly post on the Site. To request removal of such data, please contact us using the contact information provided below, and include the email address associated with your account and a statement that you reside in California. We will make sure the data is not publicly displayed on the Site, but please be aware that the data may not be completely or comprehensively removed from our systems.
